It is important for the Parties to know that The Mediator is always neutral and impartial. The Mediator does not take sides and represents none of the parties. The Mediator is there to assist the parties in finding the best possible solution to reach an acceptable outcome and resolve conflict.
PLEASE NOTE:
* All sessions can be conducted ONLINE/VIRTUAL or IN-PERSON.
* Please note that all the parties must be included in all communication during the Mediation process.
When making use of Mediation services by Liné Nel, these steps will be followed:
REQUEST FOR MEDIATION
Upon receiving a request from a client for Mediation, the other party will be contacted and invited for Mediation, if they haven’t already agreed. The process and benefits will be explained. Should both parties agree to the Mediation, a Mediation Agreement and quotation will be sent to the parties. The relevant documentation will be requested according to the matter. (Included will always be certified copies of ID’s and proof of residence of both parties.)
* GENERAL MEDIATION:
A Consultation session date and time will be scheduled for this session. The session starts with agreeing on an agenda of what needs to be resolved. Further procedures, steps and costs will be determined during this session. If it is not a very complicated matter, it usually gets resolved during this session. The amount of sessions depends on aspects that needs to be resolved. Changes to the date and time must be made at least 24 hours prior to the session.
* DIVORCE MEDIATION:
Pre-Mediation session with each party separately
This is done to introduce the client(s) to the Mediator and get to know each person individually. Background details and information are needed and also ‘where the person is at’ and what he/she wants from the mediation. Everything discussed during this session is strictly confidential. No information disclosed will be mentioned during the combined session without the consent of the relevant party. This session can also be done telephonically and duration of these sessions are around 30-60 minutes each.
1st Mediation session - Combined
A date and time will be scheduled for this session. The session starts with agreeing on an agenda of what needs to be resolved. Further procedures, steps and costs will be determined during this session. The amount of sessions depends on aspects that needs to be resolved. Changes to the date and time must be made at least 24 hours prior to the session.
ACTIONS REQUIRED
Agreements such as Parenting plans, Divorce settlements, Civil agreements, and all agreements and/or plans that need to be drawn up, will take place after agreement has been reached between the parties. The draft document will be sent out once 50% payment of the invoiced amount has been received. 2 (two) changes to the relevant document are allowed and after that an hourly rate will be applicable. Once the parties agree, the document/agreement will be finalized and released only once the balance has been paid in full.
Should Agreements need to be made an Order of Court, it will be handed it over to our Legal department for the court process. This will also be explained to- and discussed with the parties.
RATES
Hourly rate - R1 250.00
